ข้อกำหนดการใช้งาน
1. การยอมรับข้อกำหนด
การสมัครหรือใช้งาน DrugBox Care ("ระบบ") ถือว่าท่าน ("ผู้ใช้") ยอมรับข้อกำหนดเหล่านี้ทั้งหมด หากท่านไม่ยอมรับ โปรดงดใช้งานระบบ
2. คุณสมบัติของผู้ใช้
- ต้องมีอายุไม่ต่ำกว่า 20 ปีบริบูรณ์
- บัญชีผู้ใช้สำหรับ เภสัชกร ของสถานพยาบาล (เป็นแอดมินขององค์กรหรือเภสัชกรผู้ปฏิบัติงาน) พยาบาลและผู้ใช้กล่องหน้างานไม่ต้องมีบัญชี — ใช้การสแกน QR หน้ากล่อง
- ใช้งานในขอบเขตงานในหน่วยงาน — ไม่ใช้เพื่อวัตถุประสงค์อื่น
- ผู้สร้างองค์กรใหม่ต้องยืนยันอีเมลก่อน และเป็นแอดมินขององค์กรนั้น ซึ่งรับผิดชอบการอนุมัติสมาชิกและการตั้งค่า
3. ขอบเขตการใช้งาน
ระบบเป็นเครื่องมือ "ช่วยจัดการ" กล่องยาฉุกเฉิน — ไม่ทดแทน:
- กระบวนการตรวจสอบยาตาม SOP ของสถานพยาบาล
- การประเมินทางคลินิกของบุคลากร
- ระบบเภสัชกรรมหลักของสถานพยาบาล (HIS)
ผู้ใช้ต้องตรวจสอบยาและกล่องจริงก่อนใช้กับผู้ป่วยทุกครั้ง สถานะ "พร้อมใช้" ในระบบมาจากข้อมูลที่ผู้ใช้บันทึก ไม่ใช่การตรวจกล่องจริงโดยระบบ
4. ข้อมูลที่อนุญาต / ห้าม
อนุญาต:
- ข้อมูลกล่องยา ประเภทกล่อง ตำแหน่ง ชื่อยา ล็อต วันหมดอายุ จำนวน ซีล และสติกเกอร์
- การจ่าย รับคืน ตรวจ ออกซีล และการใช้ยาจากกล่อง รอบตรวจตามที่องค์กรตั้งไว้
- ชื่อผู้แจ้งและข้อความแจ้งจากพยาบาลผ่าน QR หน้ากล่อง
ห้าม:
- ข้อมูลส่วนบุคคลของผู้ป่วย (ชื่อ-สกุล, HN, เลขบัตรประชาชน, ประวัติการรักษา) — รวมถึงในช่องหมายเหตุหรือข้อความแจ้ง
- ข้อมูลละเอียดอ่อนอื่นๆ ตาม PDPA มาตรา 26
หากผู้ใช้ละเมิดข้อ 4 ผู้พัฒนาขอสงวนสิทธิ์ในการลบข้อมูลและระงับบัญชี
5. ความรับผิดชอบของผู้ใช้
ผู้ใช้รับผิดชอบ:
- ความถูกต้องของข้อมูลที่บันทึก
- การรักษาความลับของรหัสผ่าน และการออกจากระบบเมื่อใช้คอมพิวเตอร์ร่วมกัน
- การตรวจสอบนโยบาย IT ของหน่วยงานก่อนใช้ระบบกับงานจริง
- แอดมินขององค์กร: การอนุมัติสมาชิกเข้าองค์กร การตั้งค่าองค์กร และการดูแลรหัสเชิญขององค์กร
6. การจำกัดความรับผิดของผู้พัฒนา
ระบบให้บริการ "ตามสภาพ" (AS IS) ไม่มีการรับประกันใดๆ ทั้งสิ้น ผู้พัฒนาไม่รับผิดชอบต่อ:
- ความเสียหายโดยตรงหรือโดยอ้อมจากการใช้งานระบบ
- การสูญหายของข้อมูลจาก downtime, bug, หรือเหตุสุดวิสัย
- ผลกระทบทางคลินิกใดๆ ที่เกิดขึ้นกับผู้ป่วย
ความรับผิดสูงสุดของผู้พัฒนาจำกัดที่จำนวนเงินที่ผู้ใช้จ่ายให้ในช่วง 12 เดือนล่าสุด (ช่วงทดลองใช้โดยไม่มีค่าบริการ = 0 บาท)
7. การยกเลิก
ผู้ใช้สามารถลบบัญชีได้ทุกเมื่อจากเมนู บัญชีและการตั้งค่า → ลบบัญชีของฉัน ในแอป โดย:
- ข้อมูลบัญชีถูกลบทันที ส่วนชื่อในประวัติการทำงานกับกล่องยายังคงอยู่ในบันทึกขององค์กร (ดูนโยบายความเป็นส่วนตัว ข้อ 7)
- แอดมินคนเดียวขององค์กรที่ยังมีสมาชิกอื่น ต้องตั้งสมาชิกคนอื่นเป็นแอดมินก่อน จึงจะลบบัญชีได้
- สมาชิกคนเดียวขององค์กรที่ลบบัญชี = องค์กรและข้อมูลทั้งหมดขององค์กรถูกลบด้วย
ผู้พัฒนามีสิทธิ์ระงับบัญชีในกรณีที่ผู้ใช้ละเมิดข้อกำหนด
8. การเปลี่ยนแปลงข้อกำหนด
ผู้พัฒนามีสิทธิ์ปรับปรุงข้อกำหนดเหล่านี้ได้ วันที่ปรับปรุงล่าสุดแสดงไว้ที่ด้านบนของหน้านี้ หากมีการเปลี่ยนแปลงสำคัญ จะแจ้งแอดมินของทุกองค์กรและแสดงประกาศที่หน้าเข้าสู่ระบบของแอปล่วงหน้า ≥ 14 วัน
9. กฎหมายที่ใช้บังคับ
ข้อกำหนดเหล่านี้อยู่ภายใต้กฎหมายไทย หากเกิดข้อพิพาท ให้ใช้กระบวนการเจรจาก่อน หากไม่สามารถตกลงกันได้ ให้นำคดีขึ้นสู่ศาลที่มีเขตอำนาจในประเทศไทย
Terms of Service
1. Acceptance of Terms
By registering for or using DrugBox Care ("the System"), you ("the User") accept these terms in their entirety. If you do not accept these terms, please do not use the System.
2. User Eligibility
- At least 20 years old.
- Accounts are for pharmacists of a healthcare facility (as organization admin or working pharmacist). Nurses and other box users at the point of care need no account — they scan the box QR.
- Use is limited to your scope of work in your facility.
- Whoever creates a new organization must verify their email first and becomes that organization's admin, responsible for approving members and for its settings.
3. Scope of Use
The System is an "assistive tool" for emergency drug boxes — it does NOT replace:
- The drug verification process per the facility's SOP.
- The clinical judgment of healthcare professionals.
- The facility's primary pharmacy system (HIS).
Users must verify physical drugs and boxes against the facility's SOP before each use on patients. A "ready" status in the System reflects what users recorded, not a physical check by the System.
4. Permitted / Prohibited Data
Permitted:
- Drug box data, box types, locations, drug names, lot numbers, expiry dates, quantities, seals and stickers.
- Dispatch, return, inspection, sealing and drug-usage records; inspection rounds as configured by the organization.
- Reporter name and message from nurses via the box QR.
Prohibited:
- Patient personal data (name, HN, national ID, medical history) — including in notes or QR messages.
- Other sensitive personal information per PDPA Section 26.
Violations of section 4 may result in data deletion and account suspension at the developer's discretion.
5. User Responsibilities
Users are responsible for:
- Accuracy of data entered into the System.
- Maintaining password confidentiality and signing out on shared computers.
- Verifying their facility's IT policy before using the System with operational data.
- Organization admins: approving members, organization settings and the organization's invite code.
6. Limitation of Liability
The System is provided "AS IS" with no warranties. The developer is not liable for:
- Direct or indirect damages arising from System use.
- Data loss due to downtime, bugs, or force majeure.
- Any clinical outcomes affecting patients.
The developer's maximum liability is limited to the amount paid by the User in the past 12 months (free trial period = 0 THB).
7. Termination
Users may delete their account at any time via Account & settings → Delete my account in the app:
- Account data is deleted immediately; names in the box history stay in the organization's records (Privacy Policy s.7).
- The only admin of an organization that still has other members must make another member admin first.
- If the last remaining member deletes their account, the organization and all its data are deleted too.
The developer reserves the right to suspend accounts in cases of terms violation.
8. Changes to Terms
The developer reserves the right to update these terms; the "Last updated" date at the top changes with every revision. Material changes will be announced to every organization's admins and on the app's sign-in page ≥ 14 days in advance.
9. Governing Law
These terms are governed by Thai law. Disputes will be resolved first through good-faith negotiation; failing that, through the courts of competent jurisdiction in Thailand.
