ข้อกำหนดการใช้งาน
1. การยอมรับข้อกำหนด
การลงทะเบียนหรือใช้งาน DrugBox Care ("ระบบ") ถือว่าท่าน ("ผู้ใช้") ยอมรับข้อกำหนดเหล่านี้ทั้งหมด หากท่านไม่ยอมรับ โปรดงดใช้งานระบบ
2. คุณสมบัติของผู้ใช้
- ต้องมีอายุไม่ต่ำกว่า 20 ปีบริบูรณ์
- เป็นบุคลากรทางการแพทย์ หรือบุคคลที่ได้รับมอบหมายให้ดูแลกล่องยาในสถานพยาบาล
- ใช้งานในขอบเขตงานในหน่วยงาน — ไม่ใช้เพื่อวัตถุประสงค์อื่น
3. ขอบเขตการใช้งาน
ระบบเป็นเครื่องมือ "ช่วยจัดการ" — ไม่ทดแทน:
- กระบวนการตรวจสอบยาตาม SOP ของสถานพยาบาล
- การประเมินทางคลินิกของบุคลากร
- ระบบเภสัชกรรมหลักของสถานพยาบาล (HIS)
ผู้ใช้ต้องตรวจสอบยาและกล่องจริงก่อนใช้กับผู้ป่วยทุกครั้ง
4. ข้อมูลที่อนุญาต / ห้าม
อนุญาต:
- ข้อมูลกล่องยา, ชื่อยา, lot, วันหมดอายุ, จำนวน, ตำแหน่ง
- การเบิก–ใช้–คืนยา, รอบตรวจประจำเดือน
- เฉพาะตู้ยาควบคุมเท่านั้น: ชื่อและเลขบัตรประชาชนของผู้ป่วย เท่าที่กฎหมายยาเสพติด/วัตถุออกฤทธิ์กำหนดให้บันทึกในบัญชี บ.ย.ส.๒/ว.จ.๒ (กรอกเพื่อวัตถุประสงค์ตามกฎหมายนั้นเท่านั้น โดยระบบเข้ารหัสเลขบัตรให้)
ห้าม:
- ข้อมูลส่วนบุคคลของผู้ป่วย (ชื่อ-สกุล, HN, เลขบัตรประชาชน, ประวัติการรักษา) ในบริบทอื่นนอกเหนือจากบัญชียาควบคุมข้างต้น
- ข้อมูลละเอียดอ่อนอื่นๆ ตาม PDPA มาตรา 26
หากผู้ใช้ละเมิดข้อ 4 ผู้พัฒนาขอสงวนสิทธิ์ในการลบข้อมูลและระงับบัญชี
5. ความรับผิดชอบของผู้ใช้
ผู้ใช้รับผิดชอบ:
- ความถูกต้องของข้อมูลที่บันทึก
- การรักษาความลับของรหัสผ่าน
- การตรวจสอบนโยบาย IT ของหน่วยงานก่อนใช้ระบบกับงานจริง
6. การจำกัดความรับผิดของผู้พัฒนา
ระบบให้บริการ "ตามสภาพ" (AS IS) ไม่มีการรับประกันใดๆ ทั้งสิ้น ผู้พัฒนาไม่รับผิดชอบต่อ:
- ความเสียหายโดยตรงหรือโดยอ้อมจากการใช้งานระบบ
- การสูญหายของข้อมูลจาก downtime, bug, หรือเหตุสุดวิสัย
- ผลกระทบทางคลินิกใดๆ ที่เกิดขึ้นกับผู้ป่วย
ความรับผิดสูงสุดของผู้พัฒนาจำกัดที่จำนวนเงินที่ผู้ใช้จ่ายให้ในช่วง 12 เดือนล่าสุด (ในช่วง pilot = 0 บาท)
7. การยกเลิก
ผู้ใช้สามารถลบบัญชีได้ทุกเมื่อจาก Settings → Delete Account ผู้พัฒนามีสิทธิ์ระงับบัญชีในกรณีที่ผู้ใช้ละเมิดข้อกำหนด
8. การเปลี่ยนแปลงข้อกำหนด
ผู้พัฒนามีสิทธิ์ปรับปรุงข้อกำหนดเหล่านี้ได้ตลอดเวลา หากมีการเปลี่ยนแปลงสำคัญ จะแจ้งล่วงหน้าผ่านอีเมลหรือแอป ≥ 14 วัน
9. กฎหมายที่ใช้บังคับ
ข้อกำหนดเหล่านี้อยู่ภายใต้กฎหมายไทย หากเกิดข้อพิพาท ให้ใช้กระบวนการเจรจาก่อน หากไม่สามารถตกลงกันได้ ให้นำคดีขึ้นสู่ศาลที่มีเขตอำนาจในประเทศไทย
Terms of Service
1. Acceptance of Terms
By registering for or using DrugBox Care ("the System"), you ("the User") accept these terms in their entirety. If you do not accept these terms, please do not use the System.
2. User Eligibility
- At least 20 years old.
- A medical professional or a person delegated to manage drug boxes in a healthcare facility.
- Use is limited to your scope of work in your facility.
3. Scope of Use
The System is an "assistive tool" — it does NOT replace:
- The drug verification process per the facility's SOP.
- The clinical judgment of healthcare professionals.
- The facility's primary pharmacy system (HIS).
Users must verify physical drugs and boxes against the facility's SOP before each use on patients.
4. Permitted / Prohibited Data
Permitted:
- Drug box data, drug names, lot numbers, expiry dates, quantities, locations.
- Dispensing/usage/return records, inspection rounds.
- In the controlled-drug cabinet ONLY: the patient's name and national ID, where Thai narcotic/psychotropic law requires them for the บ.ย.ส.๒/ว.จ.๒ ledger (entered only for that legal purpose; the system encrypts the national ID).
Prohibited:
- Patient personal data (name, HN, national ID, medical history) in any context other than the controlled-drug ledger above.
- Other sensitive personal information per PDPA Section 26.
Violations of section 4 may result in data deletion and account suspension at the developer's discretion.
5. User Responsibilities
Users are responsible for:
- Accuracy of data entered into the System.
- Maintaining password confidentiality.
- Verifying their facility's IT policy before using the System with operational data.
6. Limitation of Liability
The System is provided "AS IS" with no warranties. The developer is not liable for:
- Direct or indirect damages arising from System use.
- Data loss due to downtime, bugs, or force majeure.
- Any clinical outcomes affecting patients.
The developer's maximum liability is limited to the amount paid by the User in the past 12 months (during pilot = 0 THB).
7. Termination
Users may delete their account at any time via Settings → Delete Account. The developer reserves the right to suspend accounts in cases of terms violation.
8. Changes to Terms
The developer reserves the right to update these terms. Material changes will be communicated via email/in-app notice ≥ 14 days in advance.
9. Governing Law
These terms are governed by Thai law. Disputes will be resolved first through good-faith negotiation; failing that, through the courts of competent jurisdiction in Thailand.
